Coronavirus (COVID-19) guidance for the charity sector

Understandably charities are concerned about what to do during these uncertain times. Here are some useful updates to the guidance for running your charity during the outbreak.

Can our charity support with COVID-19?

It has been advised that you consider the terms of your charity’s existing charitable objects first, as set out in your governing document.

Objects that might already allow you to offer support include:

• the relief of poverty
• the relief of need hardship or distress
• the relief of the elderly
• the advancement of education or advancement in life of young people
• the advancement of health

Trustees of charities may be able to adapt and respond to COVID-19 either directly or indirectly, with other objects. Please remember to check whether your objects have restrictions when considering how you can help.

You may be able to amend your governing document if your existing objectives do not allow you to help, but you will need to check your trustees have the powers to amend them.

How do I get support to pay my charity staff?

You will be able to contact HMRC for a grant to cover the cost of the majority of wages for the workforce who remain on the payroll but are not working due to COVID-19, and are furloughed.

Can I use video, teleconferencing and the internet in place of face-to-face meetings?

Some charities have clauses in their governing documents that allow them to meet virtually or to use telephone facilities. We advise trustees to check their governing document and see if they are able to make amendments to facilitate changes as to how or when meetings are held.

If you make any amends we advise that you keep a record of this to demonstrate good governance.

What do I need to report to the Charity Commission?

The charity trustees must continue to report serious incidents using current guidelines, and continue to use their judgement in deciding whether an incident is significant in the context of their charity and should be reported.
